Terms of Service & Site Rules

PDXModshop is the culmination of years of study, work and repair. Ideally servicing as a means for users to explore and experiment with technology. Over the years, exploits and oversights in many different devices have opened up the possibilities of allowing the end-user (you) to do much more with your devices than what the developers had intended. This site exists to provide tutorials and educational references to you in order for you to unlock these features yourself, if you so choose.

Please note that while you physically own the device that you might consider modifying, the software programmed on it is the intellectual property of its prospective entity (company that designed it, i.e. Microsoft, SONY, Nintendo), as such, this entity cannot stop you from tinkering with your device, but reserves the right to suspend services of a unit that they determine has been modified to function outside of its normal parameters. Not all devices are subject to this level of monitoring, but for those that are; PDXModshop will endeavor to inform users of practices that are safe, as well as ones that are not.

Furthermore, If you should so choose to modify your devices, you do so of your own accord, and indemnify PDXModshop of any responsibility on your part. PDXModshop cannot be held accountable if your device is bricked, or suspended from additional services (i.e. XBOX Live, Playstation Network, Nintendo Entertainment Network, etc etc) as a result of your modifications. Follow these guides to the letter and you will succeed in modfying your devices. Play smart, study up on safe online practices with your device, and it should not be banned from additional services.

Watermarked or proprietary images belonging to services such as Shutterstock, iStock, Storyblocks, PixaBay, Adobe Stock, 123RF, JumpStory, Pexels, Unsplash will be removed, as they are royalty trademarked images belonging to their respective copyright holders. Moderators will commit to reviewing and removing any such images from the site, or by request of a DMCA Filing by the copyright holders should any be overlooked or missed.

If you have purchased an image from any of these sites for use, you should watermark it in the lower-right corner with your username on that site, to help avoid confusion. If your paid-for image is removed by mistake; and you have the legal rights to share it, you can file a counter-claim to the removal or DMCA filing, but should include as much evidence as possible to back-up your proof of purchase and fair use of the material.

PDXModshop does not endorse the sale of pre-modded consoles, nor do we actively participate in the offering of send-in services. Absolutely no sale or pay-to-send-in services of modified consoles, phones or devices between users is permitted on ANY of our platforms (site, forums, discord, direct messages). This goes against the idea of PDXModshop as a whole. Everything needed is provided in the sites guides. You are expected to mod these devices yourself and we are providing the means for you to do so.

PDXModshop operates a store on this site, but it functions WHOLLY as a means to procure accessories and tools ONLY and will not at ANY time provide the aforementioned services. As a user, we politely request that you do not push this issue with anyone from the staff or other users. You may ask for support in helping to achieve your modding, but not to buy a pre-modded console or to have someone do it for you. This policy helps to protect this site and its users from the possibility of prosecution.

Direct offsite linking of pirated content is strictly prohibited on the site, in the comments sections, forums and discord server. All offsite links are moderated. PDXModshop is not here to share illicit copies of intellectual properties. However, the posting of homebrew games, applications and tools is encouraged and allowed. Links to homebrew should be limited to the forums whenever possible.

Pirated content includes but is not limited to game ISO images, cartridge rom dumps, XBL/PSN/eStore dumps, strategy guides and all other content that could otherwise be considered as licensed intellectual property. If it can still be bought, and its copyright registration is intact, it probably shouldn’t be posted. Even if something may be considered abandonware, PDXModshop will practice a “play-it-safe” approach rather than risk legal recourse.

No hate speech, derogatory comments, racist remarks, gender-phobic remarks, insults or foul language are permitted on the site. This site serves as a “community” and thus should behave as such. We expect all members to be polite, and helpful where possible. Most conflicts are born of dislike, misunderstanding or; in worst-case, ignorance of information, the site and its platforms have a block function and we suggest both parties proactively use it.

As the instigator, further harassment, hazing or the circumvention of blocks (i.e. double-registration) could not only lead to infractions or bans against your account, but also may result in the other party pursuing civil litigation, which we will comply with (refer to Judicial Subpoena Policy) if the legal request is sound and the evidence is present.

Nothing NSFW (not safe for work) is to be posted. If it’s something you wouldn’t show your mom, don’t show the site either.

PDXModshop fully complies with any and all DMCA requests, within reason. If content is missed by our moderators; and is later found by representatives of a copyright holder to be in violation of intellectual copyright laws, PDXModshop will endeavor to remove said content from the site.

Likewise, if a user who posted this material believes this to be in error, they are allowed to submit a counter-claim to a DMCA filing, the content will be reviewed for accuracy, and if it is found that the content is not in violation, then this counter-claim will be forwarded to the representative of the original copyright holder for review. If the decision to restore the content is positively unanimous, the content may be partially or fully restored, as removed content no longer exists on the site but may still be partially or fully retained in server backups.

If content is restored after review by PDXModshop and a companies representative legal counsel, but later removed due to a SECOND DMCA notice (by the same representative or another), then this removal of the content is considered “ultima arbitrium” (final decision), and cannot be countermanded or restored at all, failure on PDXModshop’s part to adhere to the decision at this point would invite legal prosecution that we would rather avoid.

Any and all removed content counter-claims reviewed by PDXModshop, and adverse decisions made theretofore are final, and cannot be re-submitted as a counter-claim. If you are the original poster of the content in question, do not abuse the DMCA counter-claim process if you know content that you have posted is potentially illicit in its origins.

• Any attempt to counter-argue final decisions on a counter-claim may lead to an infraction against your account, up to and including a permanent ban of your account.

In the event that PDXModshop receives a legally-bound court issued Subpoena, we will review the subpoena for accuracy, consult with legal counsel, and if the subpoena has legal merit, will surrender any information that the court is requesting.

It is our hope that this can be avoided by maintaining neutrality, by not selling pre-modded consoles, not offering send-in services and proactively working against obvious piracy practices, but in the off chance this happens, we again stress that we will scrutinize the validity of the request before turning over any such information.

Furthermore, any Cease & Desist requests will also be reviewed for accuracy and validity before any actions are taken. Removal of content or shuttering of the site in its entirety, if it is legally sound, is not outside the bounds of possibilities.

Do not impersonate PDXModshop staff. Doing so will lead to an OUTRIGHT permanent ban from all PDXModshop platforms, including the site, the forums and the Discord Server. This also extends to the act of backseat moderating, if you see something that’s against the rules, say something to the staff, do not attempt to moderate the issue yourself if you are not an active moderator. Backseat moderating may not lead to as severe a consequence as impersonation of staff, but it is greatly frowned upon.

• Failure to adhere to the policy of staff impersonation WILL ABSOLUTELY lead to an OUTRIGHT permanent ban of your account.

If you decide to donate physical items or fiscal support to PDXModshop, please do so willingly and through proper channels. All donations are final and considered irrevocable. The donations received by the community are used for the site and its fundamentals only.

Our Console Exchange donation program allows users to donate a console to help with guide research. This console MIGHT be returned to the user with the mod still installed, at no charge, as gratuity for allowing their console to be a guinea pig to the cause, but this greatly depends on the length of the research and whether or not it was successful.

If you used a guide written by a specific author, it is suggested you mention the authors name, as all proceeds will be passed along to that author. If no author is mentioned, it is assumed your donation is a general donation to the site, and will be treated as such. The donations page will have buttons for each authors own donation pages as well.

• If you donate through “BUY ME A COFFEE” your donation will be used for the author of the guide you used, to buy a coffee (as the donation suggests).
• If you donate through PayPal, it goes to site and hosting resources, unless otherwise specified.
• All server goals and funding pools are outlined in the Donations page, so you can donate towards a certain goal or pool if you would like to.

What do the “General” donations go towards?

• Hosting costs for the website, store, forums, discord (if any).
• Procurement of used or pre-owned consoles, handhelds and other devices for the purpose of researching methods for our guides, this procurement may sometimes occur outside of the Console Exchange program outlined above. This may only occur under circumstances where the guide is in demand but nobody is willing to go through with a Console Exchange for that given console.
• A coffee or two for the staff, when BUY ME A COFFEE is used as donation method.
• A small percentage (5% – 10%) of overall general donations may be used for Ad-space on Google AdSense and other advertising platforms to help bring awareness and traffic from interested users to the site. This is in lieu of any YouTube revenue that may or may not be generated from the sites videos. Any revenue that may be generated as a result of our YouTube videos will take priority and be exchanged for ad-space instead.

What “general” donations Will Not go towards:

• NO Leisure items, alcohol, tobacco, etc etc.
• NO redundant personal purchases that serve no purpose in furthering the site.
• NO store inventory (all store inventory is purchased out of pocket).

If you choose to donate to a specific author, then PDXModshop cannot determine what it will be used for, nor will we attempt to govern what that author decides to use their proceeds towards. Your donations serve as a “thank you” and if third-party authors receive donations from you, they may use them as they see fit.

Users who choose to make a regular recurring donation (via PayPal, Patreon, etc etc) to the site will be rewarded with the Benefactor role. This role allows for additional perks across the site, forums and discord. If you suspend your contributions to the site, your access to this role will be suspended as well.
